General Terms and Conditions

1. Definitions

In these terms and conditions, the following is understood:

  • Entrepreneur: Tiny Thinkers (part of DV Direct)
  • Consumer / you: the natural person who does not act for purposes related to a business or profession, and enters into a contract with the entrepreneur.
  • Distance contract: a contract in which, up to and including the conclusion of the contract, only one or more techniques for remote communication are used (for example, an order via the website).
  • Website: www.tiny-thinkers.nl (or any other domains of Tiny Thinkers).

3. Applicability

  1. These general terms and conditions apply to every offer from Tiny Thinkers and to every distance agreement concluded between Tiny Thinkers and you.
  2. Before the distance agreement is concluded, the text of these general terms and conditions will be made available to you. If that is not reasonably possible, Tiny Thinkers will indicate how you can view the general terms and conditions before the agreement is concluded.
  3. If any part of these terms is declared null or invalid, the rest of the terms will remain in effect.
  4. In case of complaints, a consumer should first turn to the entrepreneur. If the web shop is affiliated with WebwinkelKeur and if complaints cannot be resolved through mutual consultation, the consumer should turn to WebwinkelKeur (www.webwinkelkeur.nl), which will mediate for free. Check if this web shop has an active membership via https://www.webwinkelkeur.nl/leden/. If a solution cannot be reached, the consumer has the option to have their complaint handled by the independent disputes committee appointed by WebwinkelKeur, the ruling of which is binding and both the entrepreneur and the consumer agree to this binding ruling. There are costs associated with submitting a dispute to this disputes committee, which must be paid by the consumer to the relevant committee.

4. The offer

  1. Tiny Thinkers does everything possible to present the products and/or services as clearly and truthfully as possible. Any mistakes or errors in the offer do not bind Tiny Thinkers.
  2. Evident mistakes or errors in the offer, for example in prices, product descriptions, or images, do not entitle you to enforce an agreement.
  3. Each offer contains such information that it is clear to you what your rights and obligations are that are connected to the acceptance of the offer.

5. The agreement

  1. The agreement is concluded at the moment you accept the offer and meet the conditions set for it.
  2. If you have accepted the offer electronically, Tiny Thinkers will immediately confirm the receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed, you can dissolve the agreement.
  3. If the agreement is concluded electronically, Tiny Thinkers will take appropriate technical and organizational measures to secure the electronic transfer of data and will ensure a safe web environment (SSL).
  4. Tiny Thinkers may inform itself within legal frameworks whether you can meet your payment obligations, as well as all facts and factors that are relevant for responsibly entering into the distance agreement. For valid reasons, Tiny Thinkers has the right to refuse an order or attach special conditions to its execution.

6. Right of withdrawal (Reflection period)

  1. You have the right to withdraw from the agreement within 30 days without giving any reason. The reflection period starts the day after you receive the product. Within this period, you must notify us of the withdrawal (return notification). After you have done this, you have another 14 days to actually return the product. We will ensure that the refund takes place no later than 14 days after the return notification.
  2. During the reflection period, you must handle the product and packaging carefully. You may only unpack or use the product to the extent necessary to establish the nature, characteristics, and functioning of the product.
  3. If you exercise your right of withdrawal, you must return the product with all supplied accessories and – if reasonably possible – in the original condition and packaging to Tiny Thinkers.
  4. If the product is damaged or the packaging is more damaged than necessary to try the product, we may charge you for this depreciation of the product. Therefore, handle the product with care and ensure it is well packaged for a return.

7. Obligations of Tiny Thinkers upon withdrawal

  1. If you inform Tiny Thinkers of the withdrawal, Tiny Thinkers will send you a confirmation as soon as possible.
  2. TinyThinkers will refund the purchase amount paid and any standard shipping costs as soon as possible, but no later than 14 days after withdrawal, provided the product has been received back in good order.
  3. TinyThinkers uses the same payment method for refunds that you used, unless you agree to a different method. This refund is free of charge for you.

8. Exclusion of the right of withdrawal

In some cases, you may not exercise the right of withdrawal. Think of:

  • Products that cannot be returned for hygienic reasons and whose seal has been broken.
  • Custom-made products that have been made according to your specifications.
  • Audio, video recordings, and computer software whose seal has been broken after delivery.

9. The price

  1. The prices mentioned in the offer are inclusive of VAT, unless stated otherwise.
  2. Any shipping costs or other additional costs will be clearly stated in the ordering process.

10. Conformity and Warranty

  1. TinyThinkers ensures that the products and/or services meet the agreement, the specifications mentioned in the offer, reasonable requirements of soundness and/or usability, and the legal provisions in force at the time the agreement is concluded.
  2. An offered extra warranty (factory or supplier warranty) does not affect the legal rights you have.

11. Delivery and Execution

  1. TinyThinkers will exercise the utmost care in receiving and executing orders for products and in assessing requests for the provision of services.
  2. The place of delivery is the address you provided to Tiny Thinkers.
  3. TinyThinkers aims to execute orders promptly, but no later than within 30 days, unless a different delivery time has been agreed upon.
  4. In case of delay in delivery or if an order cannot be executed or can only be partially executed, you will be notified no later than 30 days after placing the order. In that case, you have the right to dissolve the agreement at no cost and to claim any compensation if you are legally entitled to it.

12. Payment

  1. Unless otherwise stipulated in the agreement or additional terms, the amounts owed by you must be paid within 14 days after the start of the reflection period, or in the absence of a reflection period within 14 days after the conclusion of the agreement.
  2. If advance payment has been agreed upon, you cannot assert any rights regarding the execution of the relevant order or service(s) before the agreed advance payment has been made.
  3. You are obliged to report inaccuracies in provided or stated payment details directly to TinyThinkers.

13. Complaints Procedure

  1. We recommend that you first make complaints known to us by emailing info@tiny-thinkers.nl.
  2. Complaints submitted to TinyThinkers will be answered within 14 days of receipt. If a complaint requires a foreseeably longer processing time, you will receive an acknowledgment of receipt within 14 days and an indication of when you can expect a more detailed response.

14. Disputes

  1. Dutch law exclusively applies to agreements between you and Tiny Thinkers to which these general terms and conditions relate.
  2. All disputes will be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.

15. Additional or Deviating Provisions

Additional or deviating provisions from these terms may not be to your disadvantage. They must be recorded in writing and will be made available for inspection if necessary.
